2. Information We Collect (Voluntary Business Inquiries)

We only collect information that you explicitly choose to provide. When you voluntarily request Founding Producer Access or register as a Clinical Producer, we collect:

• Professional Work Email: Used exclusively to deliver platform access, verify professional status, and communicate major fee schedule updates.
• Clinical Role & State: (e.g. O&P Clinician, Billing Specialist, Clinic Administrator in NY, TX, FL) to ensure relevant state fee notifications.
• Search Volume Metrics: Approximate inquiry counts (e.g. 5 searches) to administer rate safeguards.

We do not collect credit cards, home addresses, or personal phone numbers during visitor or founder mode.

3. Local Device Storage & Edge Isolation (localStorage)

Fee schedules reflect official CMS DMEPOS 2026 releases and official 50-State Medicaid fee publications (such as eMedNY). LCodeLookup serves as an administrative and pricing reference and does not replace official Local Coverage Determinations (LCDs) or guarantee claim reimbursement.

6. Your Data Rights & Immediate Removal

You have the right to request immediate deletion of any submitted business contact information or unsubscribe from communications at any time. Simply send an email to privacy@lcodelookup.com with the subject line "Data Removal Request", and your records will be expunged from our lead registry within 24 hours.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and LCodeLookup.com ("LCodeLookup", "we", "us", or "our"). By accessing or utilizing the platform, searching procedure codes, establishing custom billing profiles, adding items to the Estimate Tray, or subscribing as a Clinical Producer or Founding Producer, you affirm that:

• You are at least 18 years of age and possess the legal authority to bind yourself or the healthcare entity, clinic, or practice you represent.
• You are utilizing the platform solely for lawful, legitimate B2B healthcare administration, reimbursement research, or clinical practice management.
• You have read, understood, and agreed to all provisions set forth in these Terms and our Privacy Policy.

2. Professional Discretion & No Guarantee of Reimbursement

The statutory benchmarks, descriptors, crosswalks, and mathematical multipliers displayed on LCodeLookup are compiled from public federal and state resources. The appearance of any HCPCS code, fee schedule allowable, or calculation does NOT guarantee:

• That a specific procedure, orthosis, or prosthesis is medically necessary for any individual patient;
• That a claim will be covered, adjudicated, authorized, or reimbursed by Medicare, Medicaid, Workers' Compensation, Auto No-Fault, or any commercial insurer;
• That the fee schedules displayed represent binding, final payment amounts without payer contractual reductions, bundling edits, or deductible offsets.

All claims adjudications are governed strictly by independent payer coverage manuals, Local Coverage Determinations (LCD A52457 / A52465), and binding written provider agreements.

3. Nature of Service: Access to Software Workflows vs. Accuracy

You acknowledge and agree that any monetary consideration paid to LCodeLookup (including monthly, annual, or Founding Producer access) is paid solely for ACCESS TO SOFTWARE UTILITIES, WORKFLOW ENGINES, DOCUMENT FORMATTERS, AND EDGE INFRASTRUCTURE, and NEVER for a warranty or guarantee of data accuracy or reimbursement yield.

Healthcare fee schedules published by CMS and 50 distinct State Medicaid programs are dynamic and subject to retroactive revisions, quarterly fee updates, and local administrative adjustments. While LCodeLookup uses automated ETL pipelines to sync statutory records, you agree to independently verify all figures against primary source publications before submitting claims or executing binding contracts.

4. Zero-PHI Compliance & Client-Side Storage

LCodeLookup operates under a strict Zero-PHI Architecture (HIPAA 45 CFR § 164.514):

• Prohibited Data Entry: You shall not transmit, store, or enter any Protected Health Information (PHI)—including patient names, Medical Record Numbers (MRNs), dates of birth, Social Security Numbers, or claim numbers—into the platform.
• Physical Charting Boxes: Any demographic boxes provided on printed output documents (such as Patient GFEs) are rendered purely as blank, unpopulated lines for physical handwriting after printing.
• Local Storage Isolation: Practice billing profiles, custom commercial multipliers, and estimate tray assemblies are stored strictly inside your local web browser's localStorage. They are not transmitted to or stored on our servers, protecting your clinic's confidential contract terms.

7. Regulatory Compliance & Anti-Fraud Adherence

Users agree to strictly comply with all federal and state healthcare billing statutes. You expressly agree not to utilize LCodeLookup to:

• Engage in improper upcoding, fraudulent modifier assignment, or unauthorized code substitution;
• Unbundle additions with prefabricated off-the-shelf orthoses in violation of CMS LCD A52457 / A52465;
• Submit false or fraudulent claims under the federal False Claims Act (31 U.S.C. § 3729) or state False Claims statutes;
• Violate patient balance-billing statutory prohibitions under Workers' Compensation or Auto No-Fault (PIP) programs.

8. Mandatory Binding Individual Arbitration & Class Action Waiver

PLEASE READ CAREFULLY: THIS SECTION WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Any dispute, controversy, or claim arising out of or relating to these Terms, the Service, or any transaction with LCodeLookup shall be resolved through final, binding, and confidential individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Class Action Waiver: You and LCodeLookup agree that any claims shall be brought solely in an individual capacity and not as a plaintiff or class member in any purported class, collective, coordinated, or representative proceeding.

9. Governing Law & Inquiries

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any principles of conflicts of law. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity of remaining provisions.
